It is perfectly fine to do a condition inspection on the airplane without the transponder being inspected. However the transponder should be deactivated and labeled "INOP", or removed with appropriate maintenence record entry. Operating the transponder without the required inspection is illegal. As already pointed out the pitot static is not a required inspection, unless you plan to operate your airplane on a IFR flight plan.
